By accessing this website or submitting an enquiry form, you acknowledge that you have read and accept these Terms and Conditions. Formal engagement as a client is established only upon execution of a written Engagement Letter signed by both parties.

You must be at least 18 years of age and have full legal capacity to enter into a binding agreement in order to engage our services. If you are accessing the website or engaging us on behalf of a corporate entity, you confirm that you are authorised to bind that entity.

3. Service Description

Suan Accord provides legal advisory services in Thailand across three practice areas: Immigration and Visa Advisory, Dispute Resolution and Mediation, and Foreign Investment Structuring. Services are delivered from our office at 42/5 Tha Phae Gate, Chiang Mai, and may include remote engagement by arrangement.

Service availability is subject to our capacity at the time of enquiry. We reserve the right to decline engagements at our discretion, including where we assess that we are not well-positioned to serve the matter effectively.

Geographic restrictions: Our services are designed for matters governed by Thai law or relating to operations in Thailand. We do not provide advice on foreign law systems.

4. Engagement Process and Client Accounts

All formal engagements are initiated by a written Engagement Letter confirming scope, timeline, fees, and any specific conditions. No substantive advisory work is undertaken until the Engagement Letter is signed by the client.

Clients are responsible for providing accurate, complete, and timely information necessary for the delivery of services. Incomplete or inaccurate information may affect the quality of advice and is not grounds for fee reduction.

Client files and correspondence are treated as confidential and retained in accordance with our Privacy Policy and applicable professional obligations.

When using this website or engaging our services, you agree to:

6. Intellectual Property

All content on this website — including text, design, layout, and structural elements — is owned by or licensed to Suan Accord and is protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to access and view website content for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or create derivative works from any website content without our prior written consent.

Documents and advice delivered to you as part of a client engagement are provided for your personal or organisational use only. They may not be shared with third parties without our written agreement.

7. Payment Terms

Service fees are denominated in Thai Baht (฿) and confirmed in each Engagement Letter. Indicative fees are published on our website as starting figures and are subject to scope confirmation.

Refund policy: Fees for work already performed are not refundable. Where an engagement is terminated before completion, we will invoice for work done to the date of termination based on the agreed fee structure. Any amount paid in advance in excess of work performed will be refunded within 14 working days.

8. Service-Specific Terms

8.1 Immigration and Visa Advisory

Advisory outcomes depend on decisions made by Thai immigration authorities, which are beyond our control. We provide accurate preparation and submission support but cannot warrant specific immigration outcomes. Timelines are indicative and subject to government processing schedules.

8.2 Dispute Resolution and Mediation

Mediation is a voluntary process. We facilitate structured dialogue but cannot compel any party to reach or maintain an agreement. Settlement agreements drafted by us are legally binding once executed by all parties.

8.3 Foreign Investment Structuring

Regulatory advice reflects the law and agency practice as understood at the date of delivery. Changes in Thai law or agency interpretation subsequent to advice delivery are not within our responsibility unless an ongoing monitoring engagement is in place.

Website content is provided for general informational purposes only and does not constitute legal advice. No attorney-client relationship is formed by reading this website or submitting an enquiry form. A formal engagement relationship is established only through a signed Engagement Letter.

We make no representation that specific results will be achieved through our services. Outcomes in legal matters depend on facts, applicable law, and third-party decisions that are outside our control.

10. Limitation of Liability

To the extent permitted by Thai law, our total liability to you arising from or in connection with any engagement shall not exceed the fees paid to us under the relevant Engagement Letter.

We shall not be liable for: indirect, consequential, or incidental losses; loss of profit or revenue; loss of data; or any loss arising from reliance on general website content rather than formal engagement advice.

Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless Suan Accord, its principals, and staff from any claims, losses, or expenses (including reasonable legal fees) arising from: your breach of these Terms; inaccurate or incomplete information you provided; or your violation of any applicable law in connection with your use of our services.

12. Termination

Either party may terminate an engagement by written notice. We may suspend or terminate an engagement immediately where: you breach these Terms or the Engagement Letter; you provide materially false information; or we determine that continuing the engagement would place us in conflict with our professional obligations.

Upon termination, your right to use any work product delivered to you in the course of the engagement remains subject to payment of all outstanding fees.

13. Dispute Resolution

Any dispute arising from these Terms or an engagement with Suan Accord shall first be addressed through good-faith written communication between the parties. Where direct resolution is not reached within 30 days, the parties agree to attempt mediation before initiating formal proceedings.

These Terms are governed by the laws of Thailand. The courts of Chiang Mai, Thailand shall have jurisdiction over any dispute not resolved through the above process.

We may update these Terms from time to time. Material changes will be reflected in an updated "Last Updated" date. Continued use of the website following publication of changes constitutes acceptance. Terms governing an active engagement remain as agreed in the relevant Engagement Letter unless both parties agree otherwise in writing.
